Tricks employers use to avoid paying overtime

Under the Fair Labor Standards Act (FLSA), most workers are entitled to receive overtime pay (time and a half of an employee’s wages) for hours worked over 40 hours per week. Many employers seek to exploit employees by fraudulently classifying them as “independent contractors,” “1099 employees,” or “exempt” to avoid paying overtime. If you’re classified as any of these, you need to make sure that classification is legally correct.

Michigan also provides special protection for commissioned salespersons who are denied earned commissions. The Michigan Sales Representatives Commission Act provides legal protection to many commissioned salespersons, and requires that employers timely pay commissions. Under the act you may be entitled to your unpaid commissions and in many circumstances additional money damages including attorney fees. All claims are limited by a statute of limitations, so it is important to act quickly!
